Statutory Mandate
European Union legislation establishes mandatory baseline requirements for electrical safety, electromagnetic compatibility and radio spectrum efficiency for wireless equipment entering the common market. Formally cited as Directive 2014/53/EU, the radio equipment directive governs products that intentionally emit or receive radio waves for communication or radio-determination. The regulation applies to bare radio modules, populated circuit boards and fully assembled commercial devices sold within the European Economic Area.
Purely military hardware, amateur radio kits and automotive components covered under dedicated transport directives fall outside its administrative scope.
Conformity Assessment
Manufacturers must demonstrate compliance through designated assessment routes prior to affixing the CE mark and placing goods on the market. Harmonized standards published in the Official Journal provide a presumption of conformity when applied across hardware testing. If a wireless assembly deviates from harmonized standards, an accredited notified body must examine the technical documentation and issue an EU-type examination certificate.
Testing regimens evaluate spurious emissions, receiver sensitivity, transmitter power and electrostatic discharge immunity. Safety evaluations enforce health protection standards regarding human exposure to electromagnetic fields. Engineering teams assemble technical construction files containing schematics, test reports, risk assessments and bills of materials.
Declarations of conformity formalize legal responsibility, obligating suppliers to retain documentation for ten years following product release. Traceability rules mandate that circuit assemblies display batch or serial numbers alongside manufacturer contact coordinates.
Market Surveillance
National enforcement authorities perform spot testing on commercial retail inventory to verify ongoing regulatory compliance. Deficient compliance documentation or non-compliant radio emissions prompt mandatory sales bans or product recalls across member states. The radio equipment directive establishes the mandatory regulatory gateway for wireless electronics marketed within European territory.
